AUTO INJURY?

What You Should Say (Or Not Say) To Insurance After An Accident

What you should or shouldn't say after a car accident

Your initial insurance report means more than you may know.

Accidents can create tense situation about what you should say or not say to insurance after s car accident. After an auto accident, one of the first phone calls you may receive is from an insurance adjuster. While it may seem like a routine conversation, what you say during those early discussions can affect both your medical care and your injury claim.

First, be honest and stick to the facts. Provide basic information such as your name, contact information, the date of the accident, and the vehicles involved. If you are still experiencing pain or have not yet been evaluated by a doctor, it is perfectly acceptable to say, “I am still being evaluated and do not know the full extent of my injuries.”  You should avoid making statements such as:

  • “I’m fine.”
  • “I wasn’t hurt.”
  • “It was probably my fault.”
  • “I feel better now.”

Many accident injuries, including whiplash, soft tissue injuries, and traumatic brain injuries, may not become noticeable until hours or even days after the collision. Adrenaline can mask symptoms immediately following an accident. You should also avoid guessing about details when you are unsure. If you do not know the answer to a question, simply say so. Never speculate about speed, fault, or the severity of your injuries.

If the insurance company requests a recorded statement, remember that you generally have the right to take time to consider the request and seek guidance before providing one. Most importantly, seek medical evaluation as soon as possible after an accident. Early documentation of your injuries helps ensure you receive appropriate treatment and creates an accurate record of your condition.

When To Keep Information:

It’s generally advisable to not comment on your injuries. In those early days, your Brooks Clinic doctor may be checking things slowly to see how healing progresses.  It is not unusual to miss soft tissue damage without an MRI. As your treatment progresses, you’ll learn more about the extent of your injury. The insurance company may say something like,  “We’ve not approved your injury care.” or “That clinic often over treats.” Know the Oklahoma Law and that you have a legal right to be treated for your injuries, without prior authorization.  Your best care is our only priority.

Your focus should be on your recovery. Let the medical evidence tell the story of your injuries, rather than trying to explain them before a complete evaluation has been performed.
